Construction Act Reforms - Never Ending Story ... Part II
May 2009
After years of consultation, the proposed amendments to the HGCRA have been put to Parliament. At the end of April, the House of Lords passed the Local Democracy, Economic and Construction Bill which included the unamended revisions to the HGCRA.
It looks like the Bill will still be enacted by the end of this year (general elections permitting) but it will not come into force until the end of 2010 at the earliest. This delay is said to be to allow for a further consultation period to ensure the industry is happy with how the revised Act is to operate.
It has been a long hard road to reform and it looks like the journey is going to continue but we will only truly see the effect of the revisions to the Act when people start using them. The length of time its taken to date gives weight to the old adage that you can't please all of the people all of the time.
